Each buyer must have an assigned Buyer’s Number prior to bidding. The highest bidder on a lot shall be the buyer of the lot. The purchase price shall be the sum of (1) the price at which the item is sold, plus (2) A BUYER’S PREMIUM OF 18.5% ON THE BID PRICE OF ANY LOT THAT SELLS FOR UP TO $70,000 AND 10% ON ANY AMOUNT OVER $70,000 (for those who bid through the internet, the buyer’s premium will be 21% for lots sold under $70,000, and 12.5% for any amount over $70,000), plus (3) sales tax unless the purchaser is exempt by law from such taxes.

A refundable deposit of three hundred dollars ($300.00) by cash or cashier’s check is required of all bidders. This shall be applied to all purchases and any remaining amount shall be returned to the bidder at the conclusion of the auction.

As each item is sold, the Auctioneer shall announce the winning bid and the Buyer’s Number of the winning bid. Failure of the person assigned to the Buyer’s Number to object at the time of the announcement shall constitute an acknowledgment of the bid and purchase. The purchaser is legally liable to pay for the item or pay the difference if we must reoffer and sell the item for a lower price.

The Auctioneer shall regulate the bidding and shall be the sole arbiter of any disputes. We reserve the right to withdraw property at any time before the sale and reject a bid from any bidder.

Invoices must be paid in full by Thursday, July 14th at 4:30 p.m. or a 25% deposit paid on the day of sale. The balance of the invoice must be paid in full and merchandise picked up within three days of the date of sale. One week after the auction, left items may be moved to an off-site facility for pickup. A storage fee will be charged if merchandise is left longer than two weeks of $10.00 PER LOT PER DAY. If the property is left longer than 3 ½ (three and one-half) weeks, it will be considered abandoned. We are not responsible for shipping, but if packing and handling of purchased lots is done by us, it is done at the entire risk of purchaser. A refundable deposit may be required.

Absentee bids are accepted until fifteen minutes prior to the start of the auction for all lots in the auction.

Absentee bids for later lots may continue to be accepted according to announcements or signs posted on the office window. A deposit may be requested on absentee bids over $4000.00. The auctioneer will bid the absentee bid against floor bidders. In the event of a tie, the floor bidder shall prevail. The Gallery assumes no responsibility for failure to execute any bid for any reason and absentee bids are made subject to the Conditions of Sale. Absentee bidders are requested to call after 11am on the first weekday following the sale to find out if they were successful

No lots shall be sold, transferred, or assigned to anyone other than the winning bidder prior to the removal of the lot from the Gallery and only the winning bidder shall remove the lot.

In the event delivery cannot be made because of loss due to fire, theft, or any other reason, the Gallery shall only be liable for the return of any deposits or payments made by the purchaser.

THESE CONDITIONS MAY NOT BE ALTERED OR MODIFIED EXCEPT BY AN INSTRUMENT IN WRITING, SIGNED BY AUCTIONEER AND BUYER. Any condition statement is given as a courtesy to a client, is only an opinion and should not be treated as a statement of fact. The Gallery shall have no responsibility for any error or omission. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects

of aging.

Cash, Cashier’s check, Wire Transfer, personal check (items may be held until the check clears), and ATM.

MasterCard & VISA accepted for purchases $25 and over, but not for vehicles. If any legal action is commenced to enforce these Conditions of Sale, the prevailing party shall be entitled to recover its reasonable attorney’s fees and costs. Time is of the essence.

That Spohn bodied car is really cool. I'm afraid the complexity of the transaction, with the need for all three cars to sell makes it tough.

The Stutz is one of my favorites, I've been watching it's travels since it sold to Europe 10 years ago.

Some of the prices suggested looked reasonable, then got to the Spohn, and agree, conditional sales make things tough.

I once went to a local auction of a Corvette collector. He had an airplane hanger full of Corvettes. The catch was that he took bids like a regular auction, but reserved the right to get to the end of the auction before deciding which bids to take! This was goofy. For example, I show up and want a 1969 Corvette. I bid on the first one and get the high bid. But, I don't know if I bought it, thus don't know whether to bid on the NEXT one.

Note the two Pierce Arrow Travelodge trailers at this auction, they are neat and reasonably rare, to see two at one auction is unusual....

Agreed and I think the prices will be reasonable for a number of reasons. This auction has a number of cool cars but if you'll permit me to critique there are some issues:

1. Short notice. The auction is Tuesday and we are finding out about 4 days ahead of time.

2. Poor catalog. The pictures are few and low resolution. The descriptions are 1 sentence. Are there titles, does the car run, etc?

3. Complex sales. The most interesting cars have liens that must be satisfied as a group in order for an individual car to be sold. As Dave points out this limits bidding on more than one lot.

4. The auction company states that there is zero help with shipping which eliminates remote bidders that would need the car shipped. A traditional auto auction company would handle this with no problem. # 2 contributes to making it tough for the remote bidder too.

5. Finally, the auction commission schedule is a bit high. 21% under 70k and 12% over. Traditionally, it would be 5% to the seller and 10% to the buyer. Only 3 of those cars may go over 70k where the the fee schedule becomes reasonable.

There are a couple of cars that I would like to bid on (after a couple of beers so I forget I should be buying anything) but the above reasons make it hard.

Yes, the terms are very unfriendly, and as you mention you pretty much would have to be on site, with cash and a trailer.

I suggest you do not log onto the website to view the prices realized at this auction ... you will likely weep. Especially if you are a fan of Diamond T pickup trucks. There were about 6 of them from 1936 (my favorite year). The most expensive sold for $1800, the rest under $1,000. One for only $100. Yes, they all needed lots of work, or perhaps were parts. But dang, when was the last time you saw a 1936 Diamond T pickup that sold for less than the price of a new cadillac?

Woulda, shoulda, coulda. Then again, my wife would not be pleased with a new project in the garage.
